Definitions
Name: Beeckestijn Group conducts its activities from Stichting Beeckestijn Management Educatie,
Hogeschool Beeckestijn and Beeckestijn Business School. Hereinafter jointly referred to as “Beeckestijn”
Beeckestijn: established in Leusden, the Netherlands, as well as its legal successors under general or
special title.
Client: Any natural person or legal entity on whose instructions Beeckestijn supplies products, provides
services and/or performs work or with whom Beeckestijn enters into an agreement or with whom
Beeckestijn is in discussion or negotiation about the conclusion of an agreement.
Study program / training course / in-company: every instruction (order) from the client, in whatever form.
Agreement: any agreement concluded between Beeckestijn and the client, any amendment or addition
thereto, as well as all (legal) acts performed in preparation for and in execution of that agreement.
Services: all activities, in whatever form (services, contracts for work, supply of personnel, etc.) Beeckestijn performs for or on behalf of the client.
Article 1 – Registration & acceptance
- Registration in a training will only take place by means of a registration form on the Beeckestijn website and will be valid for the entire consecutive training period. No administration costs will be charged.
- Registrations will be deemed to have been accepted by Beeckestijn after Beeckestijn has confirmed participation by email. This confirmation will serve as proof of registration.
- After confirmation of registration, a reflection period of 14 calendar days will apply. Cancellation of a registration within these 14 calendar days is free of charge. If the moment of registration is less than 4 days before the start of the training, cancellation is free of charge until 1 day before the start of the training.
- Cancellation of registration will be free of charge if the training does not start at the first preference location.
- Cancellation of an enrollment before the start of the program can be done by sending an email to customerservice@beeckestijn.org.
- No costs will be charged for cancellations made up to 2 months before the start of the program.
- For cancellations between 2 months and 1 month before the start of the program, the client will owe 20% of the program costs, minus the value of any study materials not yet received.
- For cancellations between 1 month and 2 weeks before the start of the program, the client will owe 30% of the program costs, minus the value of any study materials not yet received.
- For cancellations less than 2 weeks before the start of the program, the client will owe 50% of the program costs, minus the value of any study materials not yet received.
- In the case of termination during the program, 50% of the agreed price (as start-up costs) will be charged, minus the value of any study materials not yet received, plus the costs of the sessions already attended, regardless of attendance at the sessions. The total costs will never exceed the agreed price.
- In the event of cancellation, all study materials already sent must be returned undamaged.
Article 2 – Examination, group assignment & individual final assignment
- If Beeckestijn conducts an examination, group assignment or individual assignment and the final interview for a certain training, this will always form an obligatory part of the programme.
- If the participant does not take part in or does not appear at Beeckestijn’s examination, final interview or group assignment, the fees will still have to be paid.
- If the participant/client takes the examination, group assignment or final interview at a later date, the participant/client will have to pay the examination fee again.
- A re-assessment (second opinion) of an examination result or final interview can only be requested in
- the event of an unsatisfactory assessment. In this situation, the participant/client will in all cases accept the fee of € 95 of this re-assessment.
Article 3 – Mid-program termination or rescheduling
- If, in certain locations, the number of participants in a program is deemed insufficient by Beeckestijn, Beeckestijn reserves the right to cancel the program before it starts or to relocate it to another venue.
- In exceptional cases, Beeckestijn may reschedule a program upon request. The decision to reschedule a program is at the sole discretion of Beeckestijn.
- Termination during the program due to attributable shortcomings is only possible based on a formal written notice of default, which must be sent by registered mail.
- Termination by the client can only occur after Beeckestijn has been given the opportunity to remedy the shortcomings. Any costs resulting from addressing the shortcomings will be borne by Beeckestijn. In the event of termination, all associated costs will be accepted by the client.
Article 4 – Terms of payment
- Payment must be made on or before the due date stated on the invoice. If payment is not made on time, the payer will be in default as of the due date. Beeckestijn will send a free payment reminder after the due date and give the payer the opportunity to make payment within 14 days of receiving the reminder.
- If the debtor fails to meet their payment obligation(s) on time, Beeckestijn will send a reminder. The debtor will then have an additional 14 days to make the payment.
- If the debtor has not paid after this period has expired, Beeckestijn is entitled to charge statutory interest on the outstanding amount as well as extrajudicial collection costs.
- These collection costs amount to a maximum of 15% on outstanding amounts up to €2,500 10% on the next €2,500 and 5% on the next €5,000 with a minimum charge of €40.
- Beeckestijn may deviate from these amounts and percentages in favor of the debtor.
- If the payer fails to meet their payment obligation(s) on time, Beeckestijn will send a second reminder, granting the payer an additional 14 days to make payment.
- If payment is still not made after this period, Beeckestijn reserves the right to charge statutory interest on the outstanding amount and to recover extrajudicial collection costs.
- These collection costs are capped as follows: 15% on outstanding amounts up to €2,500, 10% on the next €2,500, and 5% on the following €5,000, with a minimum charge of €40.
- Beeckestijn may deviate from these amounts and percentages to the advantage of the payer.
- The costs of the program and payment methods are stated in the brochure and on the Beeckestijn website. Depending on the individual participant’s preference and as specified in the brochure description of the chosen program, the program costs may be paid in installments or as a lump sum. The selected payment method must be indicated on the registration form and cannot be changed after registration.
- The employer will assume the payment obligation for the participant from the moment the completed registration form, co-signed by the employer, is received by Beeckestijn. If the employer or organization fails to meet the payment obligation or declares unwillingness to do so, the payment obligation will automatically revert to the participant.
- All stated fees are exclusive of VAT unless otherwise specified.
- The fees listed on the website are definitive.
Article 5 – Copyright on study material
- Beeckestijn holds the copyright to the educational materials it provides and compiles (excluding commercially available books). No part of these materials may be reproduced and/or published without the prior written consent of Beeckestijn or the respective authors.
- Beeckestijn maintains documentation of the assignments it carries out in a manner of its choosing, partly for the purpose of accountability and to ensure that submitted documents cannot be misused.
- If the participant fails to comply with the provisions of Article 5 in an attributable manner, they will be fully liable for all damages suffered and to be suffered by the other party as a result.
Article 6 – Applicability of terms & conditions
- The terms and conditions apply to all registration activities of Beeckestijn. By registering, the client acknowledges and accepts the general terms and conditions for registrations, registration and payment terms, and, where applicable, the provisions stated in the relevant Beeckestijn brochure. These terms and conditions, along with the provisions in the relevant brochure, constitute the entire agreement. Changes and/or additions are only possible in writing.
Article 7 – The lectures
- The participant will receive a schedule of the training days or evenings and the location where they will take place before the start of the program.
- Due to examination requirements of external examination institutes or for reasons of quality improvement, Beeckestijn reserves the right to make changes to the training programs during the course.
- For planning and logistical reasons, Beeckestijn reserves the right to occasionally deviate from the scheduled timetable.
Article 8 – Teacher unavailability
- In the event of illness and/or unavailability of a teacher, Beeckestijn will arrange for an equivalent replacement whenever possible.
- If replacement is not possible, Beeckestijn will inform the participant as soon as possible and will work promptly to schedule alternative dates.
- In the case of illness and/or unavailability of a teacher, the participant or client is not entitled to any (damage) compensation.
- Only additional costs related to the arrangement of lesson days caused by the illness and/or unavailability of a teacher will be borne by Beeckestijn.
- Teacher unavailability is not a valid reason for free cancellation. In such cases, Article 1.3 remains applicable.
Article 9 – Business partners, guest teachers & guest speakers
- Beeckestijn reserves the right to have certain trainings provided by a Business Partner authorised by Beeckestijn.
Article 10 – Confidentiality and Privacy
- All information provided by clients and/or participants is treated as confidential by the institute, its employees, and instructors. Beeckestijn Business School adheres to its privacy statement and complies with its provisions.
Article 11 – Questions & Complaints
- Beeckestijn aims to address questions or complaints as quickly and satisfactorily as possible. For questions or complaints of an administrative nature or regarding the content of the program, Beeckestijn can be reached by phone and email. Such inquiries or complaints will be answered by Beeckestijn within 10 working days from the date of receipt. Questions or complaints that require more time to process will be acknowledged immediately, with an indication of when a response can be expected.
- Beeckestijn takes all necessary measures to prevent errors in your study materials and their delivery. However, if something is incorrect, please report this within 10 days of receiving the materials. Complaints must be submitted in a timely, complete, and clearly described manner. Complaints submitted more than 2 months after the issue arises will not be accepted. If a complaint cannot be resolved through mutual agreement, it will result in a dispute that falls under the dispute resolution procedure outlined in Article 12.
Article 12 – Dispute resolution
- The agreement is governed by Dutch law, unless mandatory law dictates that the law of another country applies.
- Disputes between the participant and Beeckestijn regarding the formation or execution of agreements related to services or products provided by Beeckestijn can be submitted by either the participant or Beeckestijn to De Geschillencommissie Particuliere Onderwijsinstellingen (The Disputes Committee for Private Educational Institutions). - The Disputes Committee will only handle a dispute if the participant has first submitted their complaint to Beeckestijn in accordance with the provisions of Article 11, and this has not resulted in a satisfactory resolution for both parties.
- A dispute must be submitted to the Disputes Committee within 12 months of filing the complaint in accordance with Article 11.
- A fee is required for the handling of a dispute.
- If the participant submits a dispute to the Disputes Committee, Beeckestijn is bound by this choice.
- If Beeckestijn wishes to submit a dispute to the Disputes Committee, it must first request in writing that the participant agrees to this within 5 weeks. Beeckestijn must also announce that if the participant does not respond within this period, Beeckestijn reserves the right to submit the dispute to a regular court.
- The Disputes Committee will issue a decision in accordance with the provisions of its applicable regulations. The decision of the Disputes Committee is made in the form of a binding opinion.
